Well for the tilt feature I would imagine you would just have to tilt your head in conjunction with the 3DS so losing the focal point shouldn't be a problem.
As for those that can't watch 3D for whatever reason while it would be a bummer it would in no way make owning a 3DS irrelevant since they'd just be missing out on an effect. Owning a 3DS would still allow them to enjoy great games with improved graphics capabilities.
The gyro and the 3D focus does seem conflicting, not sure how that will work.
So the gyroscope could be used to make the sweet spot better rather than worse.

Gerstmann asked Ninty about your point specifically and they said that it was early days and not everything has been worked out.
Listening to the giantbombcast Gerstmann was the only one that had problems with the "black holes" and felt that he had to hold it unaturally to get it to work. The other 3 guys loved it and said he was high.

According to Miyamoto, depth perception makes things like flying though rings or jumping on a tree stump a whole lot easier. If a new Mario comes where you have to platform from tiny question mark block to another, lacking 3D would make it very frustrating.

Okay, firstly the motion stuff doesn't have to be used so in a game which is all about 3D, I doubt games would ask you to tilt the handheld away from your face. From the previews I have read you actually move, the handheld, your head and your body. For instance hold a book up in front of you, move to to the side and turn with your body. Your head is still at the same angle, you are still looking at the center of the book, but you have moved the handheld and the sensors have detected that.
On the kids issue its only a problem for very young children because the muscles in their eyes haven't formed yet. It's a standard warning over 3D content.

They should feel bad, because humans without functioning depth perception are sub human. What animals lack depth-perception? That's right, herbivores. A.k.a. food. I bet people that have trouble viewing 3D are vegans!

I listened to another podcast with him and his co-horts and he was riding the same point again.
Jeff specifically does not care much for Nintendo, so you have that going for starters. But he is so insistent against the pressure of his friends in the casts I listened to, that in this case I think it might be medical. He was even saying his eyes were hurting.

...but then there is ALSO a Gyroscope and tilt technology built into the system. As was described by the developer, there are some first person games, for example, where you'll have to tilt the system up and down, left and right to change your perspective in the game. How is this going to work with this "sweet spot?" Isn't moving the system around while you are viewing from a certain angle going to disrupt the stereoscopic effect? Is there something that tracks your head movement as you are playing to adjust the 3D view accordingly?
Just thinking out loud here.
Also, what's up with the few people that can't see the 3D effects? Are they going to be locked out of an entire generation of Nintendo Portables? Yes, yes. I know you can turn the 3D on and off, but that is like playing a light-gun game with a cursor... What's the point?
Finally, it's not recommended that small children play the 3DS as it may affect their developing eyes. Errr. What does that mean for adults? Eyestrain and head-aches for us big portable people...?
I know we are often accused of being a pro-Nintendo site, but that doesn't mean we can't consider potential negative aspects of Nintendo products.
