Options running out for Microsoft with ITC now one step away from prohibiting console sales, but verdict not yet enacted


Microsoft is feverishly trying to escape one of the most disastrous legal rulings imposed on the company in its thirty-seven-year history, after the International Trade Commission (ITC) was advised on Tuesday to ban the import and sale of Xbox systems in the United States.


Judge David Shaw said Microsoft should be handed a cease-and-desist order on sales of Xbox 360 Slim consoles across the country, as part of an increasingly complex and bitter legal dispute between the company and Motorola Mobility.


The legal war – fought in courtrooms in Germany, the US and an ITC panel – has proven to be extraordinarily expensive for both parties. A Seattle judge recently claimed that attorney fees already spent “could finance a small country”.

The ITC commissioners can either allow the initial determination stand, or amend certain terms, or send it back for a rewrite. If Shaw's recommendation is enacted, President Barack Obama will have 60 days to review the decision, according to the Courthouse News Service.


At the heart of the issue is a patented Motorola Mobility technology that Microsoft uses across a number of devices and technologies such as Windows 7, Internet Explorer, Windows Media Player and Xbox 360 S.


Microsoft alleges that Motorola Mobility breached contract by demanding “unreasonable licensing fees” for use of the patents. It is believed the royalty rate would have been 2.25 per cent for each unit sale, something which is argued would cost Microsoft some $4 billion each year.


Motorola’s counter-claim is that Microsoft gave up its right to negotiate on the royalty rate as soon as it began lawsuit action.


In April, a court in Germany declared Microsoft consoles should be banned across the country. This verdict will not come into effect until the US lawsuit is concluded.

Microsoft, which has defied all major outcomes of the case, has warned the ITC that banning Xbox 360 across the US would not serve the public interest, because it would leave the market with a choice between PlayStation 3 and Nintendo’s Wii.


Shaw rejected the argument, claiming that enforcing intellectual property rights takes precedence.


Most Xbox 360s in the US are imported from China – a business practice considered vital in driving down production costs.


Motorola Mobility is currently in the process of being acquired by Google


But Judge Shaw’s recommendation to the ITC now threatens to throw the Xbox US business into disarray.


He believes Microsoft should not only cease Xbox imports from China, as well as ban general sale of the console across the country, but also pay Motorola Mobility 7 per cent of the value of any unsold systems remaining in stores.

So they would have to pay 7% to motorola for unsold units, how much for the millions sold already?

Probably but I don't think I've seen any copies here at the stores I frequent and to be honest there's just too many other games I want to get first for me to go out and actively search for this one.

I really hope this isn't true man....honestly as good as some of the Star Fox games are, they are really the stupidest characters ever created and throwing them in the Metroid universe would have people who cried foul at Metroid Other M commiting suicide. The Star Fox stuff would either have to be designed to somehow be ultra dark and gritty, or the Metroid stuff would have to be totally dumbed down and fluffy....give Samus a bouncy squeaky happy personality. Just no.

I would really prefer that Retro be working on something completely new. Let them create some original IP and see if they can work some N64-era Rare magic.

Maybe they should start making the fucking console in the USA and bring the country some much needed jobs? Oh that's right...then they would have to pay the workers a reasonable income.

Dead Space2 is really awesome. A bit too slow at times but a true horror game, I am scavenging for bullets and health, feels so good. I don't remember the first one being so hard on the ammo, I like it like this. This is easily one of the greatest new franchises this gain and it has already jumped over Silent Hill as the second greatest horror game franchise.

With patent disputes, the alleged infringer will often preemptively sue the patent owner in order for the legal battle to take place in the preferred legal setting (country, state).  The jump would be that they don't have license to distribute products with that patent.

Yeah Dead Space 2 is an excellent game. I didn't care to much on how they did the last little bit of the game and the final boss was disappointing but the overall game is still great stuff.

I seriously doubt that the 360 will end up getting banned in the U.S. If worse comes to worse I'm sure Microsoft will just pay the money. By the way is the ban just for the U.S. or can Canada be affected as well? Maybe I'll grab a 360 Slim just to play it safe. Nyaa

And the Dualshock was not banned. Sony chose to remove vibration to avoid paying royalties to Immersion. Ultimately they chose to pay them off.

Not true!

They removed the vibration because it would interfere with the motion controls, and because nobody cared about vibration anymore, being a last gen technology. lol

Where the he'll did that MS lawsuit cone from, banning sales of 360 WTF?! It seems like MS started the lawsuit how come it got reversed and now they are in trouble? I don't get where the jump is made from motorola having parts in all MS devices to banning 360.

Seems like MS uses a lot of other peoples patents like rumble in the original Xbox. From what I read they use a bunch of Motorola stuff but are not willing to pay the licensing costs that Motorola wants, so they just use the patents anyway and hope to drag out a legal case. By the time this case is settled the nextbox will be out and it wont mean shit. Unless the judge orders MS to back pay Motorola:

"Microsoft alleges that Motorola Mobility breached contract by demanding “unreasonable licensing fees” for use of the patents. It is believed the royalty rate would have been 2.25 per cent for each unit sale, something which is argued would cost Microsoft some $4 billion each year."

And the Dualshock was not banned. Sony chose to remove vibration to avoid paying royalties to Immersion. Ultimately they chose to pay them off.

Because they knew they would lose the case. They essentially DID lose the case several times, kept appealing and would have been screwed if they didn't settle:

While Microsoft settled out of court, purchasing a 10% share in Immersion,[3] Sony continued to defend the case. Immersion's lead attorney in this case was Morgan Chu.[4] The defense centered on a force feedback controller patent which Sony licensed from Logitech during 1998.[citation needed] Sony lost, with the jury awarding Immersion $82 million[5] for the seven years that the DualShock controller had been on the market,[citation needed] which with the judge's addition of pre-judgment interest and costs, totalled $90.7 million.[5] In addition, the judgment required Sony to suspend the sale of all controllers containing Immersion-patented technology, including all PlayStation and PlayStation 2 console packages. Sony appealed this decision and has been able to sell its products while the appeal was being heard. On 2006-03-12 Sony lost the appeal at the US District Court level and subsequently appealed to the US Court of Appeals for the Federal Circuit.[6] The order to halt sales of the infringing controllers was again stayed pending the outcome of the appeal.

At E3 2006, Sony announced that vibration functionality would be removed from the PlayStation 3 controller, reasoning that the vibration would interfere with the motion-sensing feature of the controller. It has been speculated that the removal of vibration is related to the lawsuit,[7] and Immersion President Victor Viegas has been dismissive of Sony's stated rationale.[8]


On March 1, 2007, Sony Computer Entertainment and Immersion Corporation announced that both companies have agreed to end their patent litigation, and have entered a business agreement to "explore the inclusion of Immersion technology in PlayStation format products."[9] As part of the agreement reached between the two companies, Immersion will receive the full amount dictated by the District Court, which with interest is stated to total $97.2 million, in addition to royalties. On top of the $30.6 million in compulsory license fees which Sony had paid Immersion over the previous two years, Sony will make 12 more licensing payments through the end of 2009 totaling $22.5 million, during which other royalties may also be paid.[5] The agreement also provides Sony with new rights with respect to Immersion's patents. The termination of the litigation will have no material impact on Sony's consolidated earnings forecast announced on January 30, 2007.[9]

Yeah, they lost, they paid, they had to.

Immersion got everything to court demanded and more.
