I'm not familiar with U.S. law (hell, not even familiar with the laws of MY own country), but I guess a class-action lawsuit would be the path to go here.
And yeah, the Skyrim PS3 fiasco depends largely on the system's hardware, and the way its RAM is allocated as opposed to that of the 360. It's a structural problem that lies much deeper than only game code.

Here you have a legal right return faulty goods or goods that aren't as described. You go to the store and demand it, otherwise you go to a small claims court, represent yourself. You don't sue for thousands or anything you just present your case to a small panel or judge.
But it's probably better to write to the shop's business complaints dept first.

Yep, a class-action suit is probably what will happen should Bethesda not man up and announce a product recall. I don't know, I guess a large part of it will come down to the owners of the game. Most of the issues doesn't occur until the 65 hour mark or so. You have to really decided whether or not most gamers will play that long. There's some stat out there that could be pretty bogus, but it did state that only like 20% of games sold get completed.
Ahhhh well, I'm just happy that a lot of media sources are now picking it up and its becoming fully public knowledge. Hopefully it'll make other devs start weighing if they should be developing mult-platform games as often as they do.
I find them mildly insulting. If you're in court and about to judged, to have someone in a black cape and grey curly wig is just beyond the pale.

You know the Irish judges wear those wigs too, but after their economic meltdown they ended the wig wearing as a cost-cutting measure. Apparently each wig costs something like $4,000 dollar and they get new ones once a year or so.
