I removed the 3DS battery new and replaced it with the original source from neogaf that links directly to Nintendo site. The news story before was from CVG and they got their info from Kotaku. There was some incorrect data in the CVG and Kotaku news. They claim that the 3 to 5 hours is when played with the lowest brightness setting. The original source does not specify which brightness setting the 3-5 hours are from.  So if could be that the 3 and 5 hours are from the highest brightness setting, which would put it in the same league as the DSi

Another thing to consider is that the NDS has an mode where it is always on Wi-Fi. Wi-Fi is a major battery drain, maybe that is why the number is so low. Luckily you can switch that off.

4 hours give or take 1 would not be fine by me.  I need a handheld to at least last me through an average flight or train journey.  It's the reason why the DS goes places with me while the PSP stays home to watch after the kids

I suspect it at the highest level with stuff turned on. Because this would explain why the battery life with DS games is much lower despite it having a much bigger battery.

Well Nintendo said they were trying to get DSi level Battery life so that would be good I always had my DSi on the lowest brightness settings with the sound low because I'm not a fan of having the sound really loud.so I should get really good battery life if the volume is low, the brightness is at it's lowest setting and the 3D is at it's max setting.
