"Modifying a console and computer is considered an illegal act under Section 342.1 of the Criminal Code and is punishable by imprisonment for up to ten years." - RCMP statement
The full details of Section 342.1 are as follows...
Every one who, fraudulently and without colour of right,
(a) obtains, directly or indirectly, any computer service,
(b) by means of an electro-magnetic, acoustic, mechanical or other device, intercepts or causes to be intercepted, directly or indirectly, any function of a computer system,
(c) uses or causes to be used, directly or indirectly, a computer system with intent to commit an offence under paragraph (a) or (b) or an offence under section 430 in relation to data or a computer system, or
(d) uses, possesses, traffics in or permits another person to have access to a computer password that would enable a person to commit an offence under paragraph (a), (b) or (c)
is guilty of:
(e) an indictable offence and liable to imprisonment for a term not exceeding ten years, or
(f) an offence punishable on summary conviction.
Not just "possible" but entirely the point of the wording. Legal statements are worded the way they are specifically to remove ambiguity and cover all angles. Here, the purpose of "with intent to commit an offence" is to make it illegal to sell modded systems for wherein the intent is clearly for the use of illegally accessing content -- intent has nothing to do with the consumer; however, consumers have a problem if they subsequently use a modified system to access content illegally.
You can,
-Own a modded system
-Use a modded system for legitimate purposes
You cannot,
-Sell a modded system wherein the intent is for illegal use
-Use a modded system illegally
Section (b) is much more of concern because it's phrased incredibly ambiguously
"(b) by means of an electro-magnetic, acoustic, mechanical or other device, intercepts or causes to be intercepted, directly or indirectly, any function of a computer system,"
Keyboards work by a process known as "interrupts" wherein the computer continually polls for a signal that says new input has been received, and then stops to take care of what it needs to with that input. That's "indirectly intercepting a function of a computer system". I presume the intent of the law is to make man-in-the-middle and DoS attacks illegal, but it's terribly phrased.
EDIT: Definition of "intercept," in the section:
"“intercept” includes listen to or record a function of a computer system, or acquire the substance, meaning or purport thereof;"

Gears Of War 3 gameplay details leak
Edge reveals new cover system and underwater scenes
Bit disappointed about missing out on tonight's potential Gears Of War 3 reveal? Us too.
Just as well Edge is reporting a number of details about the title's gameplay, then.
A 'trusted US publishing source' has told the site that the developer's set to shake up the much praised - and imitated - Gears cover system.
New Locust enemies will reportedly have tentacle-like limbs which can reach out to player cover spots, while COGs will carry explosives that can travel beneath the surface to destroy enemy cover locations.
You can forget about pushing around burnt out cars too - mobile cover will come in the form of a hefty mech suit that offers not only protection but also the tools to dish out some carnage.
These cover system innovations will be on offer in both the singleplayer and multiplayer game, according to the site.
The game will also take place in the summer and feature brand new environments for the series, including underwater, so Marcus will have to break out the wetsuit.
Edge also speculates that jungle or foliage-heavy areas could appear in the game, as hinted at by Epic's Unreal Engine 3 demo at GDC in March.
There's no official word yet on Gears 3, so we'll just have to wait and see whether it's on the agenda for Cliff Bleszinski's US TV appearance on Monday night.
Edge has contacted Microsoft for comment.

If I have money sure, if not I have a friend that will lend me his PSP when the game hits. I'm playing it either way.
This game comes out June 8th, that gives me about 2 weeks to beat Galaxy 2, nice. I might be playing the two best games of the year back to back.
