Who is responsible if a driver parks illegally and causes an obstruction?

This is the scenario:

A small underground car park, all the bays are filled with cars whose owners have permits.

A new car enters, not able to find an empty bay this driver parks in the middle of the throughway, blocking in two cars on either side of him, as well as causing an obstruction to the entrance/exit.

Someone has to leave and in trying to avoid the illegally parked vehicle, damages the rear of their car on the corner of a wall. There is negligable contact between the two cars, leaving a minor scuff mark on the illegally parked cars' drivers side wing mirror. Yet the other car has damage to the back of their car.

not saying it's fair or it's how it should be, just saying how it is here at least.

Actually, I'd say that's how it should be; well, the illegally parked car depending could be towed as well.  But it's not a free opportunity to smash up a car, however unfortunate.

Yup, that's how the insurance company sees it. And yet there is no parking control in the private carpark and thus no redress to be had, no clamping, no fines, nada.

One asshole can block 20 cars.
